Indiana’s open burning laws and rules (326 IAC 4-1-2 and 4-1-3) make it illegal to burn trash and generally prohibit open burning in Indiana, except for exempt burning activities. Where exemptions apply, you must follow requirements and conditions in state rules and local ordinances. St. Joseph County Code of Ordinances (Chapter 92), strengthened by the leaf burning ban, prohibit open burning, but allow certain exemptions. One exemption is “Fires used for recreational and cooking purposes, i.e., camp fires”. The county also announces an amnesty week in spring and fall which allows burning in a screened-in container with a lid. The HOA Board strongly recommends alternatives to burning leaves and yard waste during amnesty week.
Many of our neighbors enjoy camp fires and burn fire wood in outdoor fire pits all year. The Board simply asks that everyone use common sense, be respectful of your neighbors, and, follow the state rules and local ordinances:
· Only clean wood products shall be burned, i.e., no leaves, pine needles, bushes, trash;
· Fires shall be attended at all times by an adult until completely extinguished;
· Adequate firefighting equipment, such as a water hose, fire extinguisher, and/or shovels, must be kept on-site while burning;
· Do not burn during high wind conditions or temperature inversions, when air is stagnant, or when an Air Quality Action Day is declared;
· Fires must be extinguished if at any time they are causing a pollution problem, a threat to public health, a nuisance, or a fire hazard.
This issue comes to our attention every year. Friendly reminder - the county roads require a valid driver’s license. We strongly discourage kids from driving the golf carts.
